Terms of Use

Welcome to RiskDesk ("RiskDesk", "we", "our", or "us"). These Terms of Use ("Terms") govern your access to and use of the RiskDesk macOS and iOS applications ("App"), including any content, features, and services offered through the App.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 18 years old to use RiskDesk. By using the App, you represent and warrant that you meet this requirement.

2. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices that you own or control, solely for your personal, non-commercial use.

3. Subscriptions and Payments

RiskDesk offers the following auto-renewable subscription plans:

• RiskDesk Pro — Monthly: Billed monthly at the price displayed at the time of purchase.
• RiskDesk Pro — Annual: Billed annually at the price displayed at the time of purchase.

Subscription details:

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
• You can manage and cancel your subscriptions by going to your Account Settings in the App Store after purchase.
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.

Current subscription pricing is displayed in the App prior to purchase. Prices may vary by region and are subject to change. Any price changes will take effect at the start of the next billing period following notice.

4. Free and Pro Features

RiskDesk may be used without a subscription with limited functionality. A Pro subscription unlocks additional features including but not limited to:

• Stocks and ETFs position sizing
• Live and automated TradingView strategy orders via webhooks
• Unlimited tracked positions
• Broker connections (MT5, OANDA, Alpaca, and others)
• Risk Lab — drawdown and ruin analysis
• Monte Carlo and market stress modelling
• Performance analyser, trade journal, and calendar
• Multi-broker trade copier

5. No Financial Advice

RiskDesk is an analytical tool only. The App does not provide personalised financial, investment, legal, or tax advice. All information, calculations, and analytics provided by the App are for informational and educational purposes only.

You are solely responsible for your trading and investment decisions. Past performance metrics displayed in the App do not guarantee future results. Trading in financial markets involves substantial risk of loss and is not suitable for every individual.

6. User Content

You retain ownership of any data, trade entries, journal notes, and other content you enter into the App ("User Content"). You are solely responsible for your User Content and for ensuring that it does not violate any applicable laws.

7. Prohibited Conduct

You agree not to:

• Use the App for any unlawful purpose
• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorised access to any systems or networks connected to the App
• Redistribute, sublicence, or resell access to the App
• Use the App to develop a competing product or service

8. Intellectual Property

All rights, title, and interest in and to the App, including its design, code, graphics, logos, and trademarks, are owned by RiskDesk or its licensors. These Terms do not grant you any rights to use RiskDesk's trademarks or branding.

9. Third-Party Services

The App may integrate with third-party services such as brokers, market data providers, cloud storage, and analytics platforms. Your use of those services is subject to their own terms and privacy policies. RiskDesk is not responsible for the availability, accuracy, or conduct of any third-party service.

10. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that any data or calculations will be accurate or reliable.

11. Limitation of Liability

To the maximum extent permitted by applicable law, RiskDesk and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or trading losses, arising out of or related to your use of the App.

12. Indemnification

You agree to indemnify and hold harmless RiskDesk and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your User Content, or your violation of these Terms.

13. Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your licence to use the App will immediately cease. Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which RiskDesk operates, without regard to its conflict of law provisions.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the Effective Date above. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms.
